RECYCLE SERVICE TERMS

PLEASE READ THE BELOW RECYCLE SERVICE TERMS CAREFULLY BEFORE ACCESSING OR USING OUR RECYCLE SERVICE. These terms apply to our recycle service and shall be deemed a part of the Terms of Use. Your access and use of our recycle service constitute your agreement to be bound by both the terms hereof and the Terms of Use.

1. Recycle service enables NNN Fabulous Limited (‘us’ or ‘we’, as the context may require) to collect and recycle the goods and items specified by you (the “Recycled Goods”) at your request (‘Recycle Service’).

2. Our Recycle Service mainly involves four (4) steps:

Step 1 Take a photo and provide a description of the Recycled Goods – including quantity, size, style, color or other specifics. Please also provide your personal details including personal identification, email, mobile contact and bank account details.

The photo, goods or items description, together with your personal details shall be submitted to email: luxecityhk@outlook.com; SMS; WhatsApp; WeChat; for processing.

It is your responsibility to ensure that the photo you submit are clear and visible, the goods or items description details are accurate, and your personal data are up-to-date.

We reserve the right to request for further information and details on the Recycled Goods from time to time, and if thought fit, we reserve the right not to provide our Recycle Service to you at our discretion if we are unable to obtain clarity or information we require with respect to the Recycled Goods.

Step 2 Upon receiving the photo (as provided in Step 1), we shall provide you with a preliminary purchase price of the Recycled Goods (the “Preliminary Purchase Price”) via whatsapp, wechat, SMS and/or email (as provided in Step 1).

Step 3 If the Preliminary Purchase Price of the Recycled Goods:-

a. is less than HK$ 20,000, you shall be responsible to make delivery arrangements and/or deliver the Recycled Goods to our physical store in person during business hours;

b. is between HK$ 20,000 – HK$ 39,999, we may arrange delivery of the Recycled Goods with costs to be borne by us (the method of which be at our discretion); or

c. is HK$ 40,000 or above, we may arrange door-to-door collection service of the Recycled Goods.

Upon arrival of the Recycled Goods at our physical store, an acknowledgement of delivery (or e-receipt or such other evidential documents, as the case may be) containing details of time and date of arrival of the Recycled Goods will be sent to you accordingly.

We shall then agree with you in writing – via whatsapp, wechat, SMS and/or email – on the final purchase price of the Recycled Goods (the “Final Purchase Price”).

You acknowledge that the Final Purchase Price of the Recycled Goods, as agreed, shall be final and binding amongst us.

We shall then remit the Final Purchase Price to your designated bank account (as provided in Step 1) within seven (7) days, or alternatively, you may arrange cash collection at our store in person during business hours.

Step 4 The Recycled Goods shall then be placed at our store for display and selling by us.

3. You acknowledge that in the course of our provision of Recycle Service to you, we do not assume any responsibility, and shall not be held liable for any loss and damages suffered by you due to inaccurate or wrongful supply of information by you. You are solely responsible for the accuracy and completeness of all your personal data and information (as provided to us).

4. You warrant and represent that the Recycled Goods (or to be recycled goods) as delivered to us for recycle purpose are authentic and not counterfeit.

If, upon arrival of the Recycled Goods at our store, we are unable to confirm the authenticity or value of the Recycled Goods (or to be recycled goods), you acknowledge and agree that we shall have the absolute discretion to reject providing Recycle Service to you, return the Recycled Goods to you, surrender and/or report to the relevant authority (including without limitation to the Customs Department of Hong Kong) concerning the Recycled Goods (or to be consigned goods) without any notice.

For the avoidance of doubt, if you have received our notification of return of the Recycled Goods, and that the Recycled Goods remain un-collected by you in person at our store within thirty (30) days, you acknowledge and agree that we shall have the absolute discretion to deal with or make any arrangements of the Recycled Goods including without limitation to disposal of the Recycled Goods without further notice.

5. The Preliminary Purchase Price and/or the Final Purchase Price of the Recycled Goods shall be assessed and agreed upon independently on a case-by-case basis subject to the circumstances then subsisting.

You acknowledge and agree that the Preliminary Purchase Price and/or Final Purchase Price shall be subject to the below non-exhaustive considerations, and that we reserve the right not to provide our Recycle Service to you at our sole discretion if we are unable to obtain clarity or information we require with respect to the Recycled Goods (see Step 1 above):-

a. color and/or size deviations between the actual object and your submitted photos;

b. damage or lost caused by logistic company during transportation and/or delivery;

c. failure to present valid record or provide the necessary information we request concerning your identity and/or the Consigned Goods (or to be consigned goods);

d. the Recycled Goods have (or has) been a subject of repetitive use or fair wear and tear, the condition of which is, in our view, different as compared to your submitted photos and that it is unrealistic to expect a successful sell of the Recycled Goods;

e. damage caused by artificial modification;

f. goods that do not involve quality problems or issues; and

g. such other conditions or criteria we deem fit from time to time, giving reasonable considerations.

6. You shall be responsible to do all necessary restoration, cleaning and/or repair work before delivering the Recycled Goods to us.

7. We are not responsible, and shall not assume any liability for any delay, losses, errors and damages caused by force majeure, such as bad weather, flight delays, crashes, wars, riots, or traffic accidents beyond our control. We are also not responsible, and shall not assume any liability for any delay, losses, errors and damages caused by the logistics and/or shipping company, including but without limitation to inappropriateness or improper packaging; or wrongful or improper declaration in violation of the applicable laws and regulations.

8. You acknowledge that any payments made by us to you (ie. the Final Purchase Price of the Recycled Goods) may be made via Credit Card, [AlipayHK, WeChat Pay HK, FPS] or such other online payment processing gateways as may be made available from time to time. As such, you shall be subject to and/or restricted by the terms of use governing the usage of the Credit Card, [AlipayHK, WeChat Pay HK, FPS] or such other payment gateways.

Without prejudice to the foregoing, you acknowledge and understand that the foregoing payment methods or gateways may involve third-party applications, and that we have no responsibility or control over the security or effectiveness of the chosen payment method. These third-party applications may experience errors and interruptions and may not be totally secure. You acknowledge and understand that these applications or software may be a subject of hacking or cyber fraud, and hence you will use these applications or software entirely at your own risk. We do not supply, provide or endorse any third-party applications or software.

All monies payable by us are primarily denominated in Hong Kong Dollars (HK$), or otherwise in other foreign currency as may be agreed between us in writing.

You undertake to inform us immediately on any updates of your personal details as necessary including without limitation to your bank account details.

9. You warrant that you will comply with all applicable laws and regulations relating to the Recycled Goods. To the extent permissible, you are liable to us for any loss or damages resulting from your failure to comply with the applicable regulations and laws.

10. These terms, including any rights granted or obligations created hereunder, may not be transferred or assigned by you, but may be assigned by us without restriction.

11. Our failure to insist upon strict compliance with any provision of these terms or to assert any right we may have hereunder shall not be deemed to be a waiver of such provision or right or any other provision or right of these terms.

12. If any provision of these terms is held to be illegal, invalid or unenforceable, in whole or in part under any laws, such provision or part thereof shall to that extent be deemed not to form part of these terms but the legality, validity and enforceability of the other provisions in these terms shall not be affected. In such case, those illegal, invalid or unenforceable provision or part thereof shall deemed to be automatically amended, and be replace by provision that is legal, valid and enforceable and that has, to the greatest extent possible, a similar effect as the illegal, invalid or unenforceable provision or part thereof, given the contents and purpose of these terms.

13. These terms constitute the entire agreement and understanding between us with respect to the access and use of our Recycle Service. These terms supersede any and all prior or contemporaneous communications, representations, statements, agreements, and understandings, whether in oral, written, or electronic form, between you and us concerning our Recycle Service.

14. These terms, and as applicable, the terms stated under the Terms Of Use shall be construed as consistent with each other whenever possible, but if such construction or consistency is unreasonable due to conflicting terms, these terms shall prevail to the extent of such inconsistencies.

15. These terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with their subject matter or formation shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (‘Hong Kong’). Each party irrevocably agrees that the Courts of Hong Kong shall have exclusive jurisdiction to settle any dispute(s) or claim(s) (including non-contractual disputes or claims) that arises out of or in connection with these terms or their subject matter or formation, and irrevocably waives any objection which it may now or hereafter have to the courts of Hong Kong being nominated as the forum to hear and determine any such claim or dispute and agrees not to claim that any of such court is not a convenient or appropriate forum.
